Terms of Service

1. Acceptance of Terms

By accessing or using the Buildaverse website, applications, game client, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Buildaverse LLC ("Buildaverse," "we," "us," or "our"). We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years of age to create an account or use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf. We do not knowingly collect personal information from children under 13. If we learn that we have collected information from a child under 13, we will delete that information promptly. See our Privacy Policy for more details.

3. Your Account

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete information when creating your account.
• Not share your password or account access with anyone else.
• Notify us immediately if you believe your account has been compromised.
• Not create more than one account per person without prior approval.

We are not liable for any loss or damage arising from unauthorized use of your account.

4. User Conduct

You agree not to use the Service to:

• Harass, bully, threaten, or intimidate other users.
• Post or share content that is sexually explicit, excessively violent, or otherwise inappropriate.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Upload or distribute malware, viruses, or any other harmful software.
• Engage in scamming, phishing, or fraudulent activity of any kind.
• Exploit bugs, glitches, or vulnerabilities in the Service for personal gain instead of reporting them.
• Use automated scripts, bots, or third-party tools to access or interact with the Service unless explicitly authorized by us.
• Attempt to gain unauthorized access to other users' accounts or any part of the Service's infrastructure.
• Post or share personal information of another person without their consent.
• Engage in real-world trading of virtual items or currency for real money, gift cards, or other external value unless through official Buildaverse-supported features.
• Circumvent any restrictions, bans, or moderation actions applied to your account.
• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.

5. User-Generated Content

The Service allows you to create, upload, and share content including but not limited to avatar items, forum posts, messages, and place builds ("User Content"). You retain ownership of your original User Content, but by submitting it to the Service you grant Buildaverse a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute your User Content in connection with operating and promoting the Service.

You represent that you have all necessary rights to submit your User Content and that it does not infringe on the intellectual property rights of any third party. We reserve the right to remove any User Content that violates these Terms or that we find objectionable, at our sole discretion and without prior notice.

6. Virtual Currency and Items

The Service may include virtual currencies (such as "Cash" and "Coins") and virtual items. These virtual goods have no real-world monetary value and cannot be redeemed for real currency, goods, or services outside of the Service except where explicitly offered by us.

• All purchases of virtual currency are final and non-refundable except where required by applicable law.
• We reserve the right to modify the pricing, availability, or functionality of virtual currency and items at any time.
• Virtual currency and items are licensed to you, not sold. Your access to them is subject to these Terms and may be revoked if your account is terminated.
• Attempting to fraudulently obtain virtual currency or items (including through chargebacks, exploits, or unauthorized means) may result in immediate account termination.

7. Intellectual Property

The Service, including its design, logos, trademarks, code, game assets, and all original content created by Buildaverse, is the property of Buildaverse LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on any part of the Service without our prior written consent.

If you believe that content on the Service infringes your copyright, you may submit a notice to us at [email protected] with a description of the copyrighted work, the infringing material's location, and your contact information. We will respond to valid notices in accordance with applicable law.

8. Account Termination and Suspension

We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise detrimental to the Service. Grounds for termination include but are not limited to:

• Repeated or severe violations of the User Conduct rules.
• Fraudulent activity, including payment fraud or chargeback abuse.
• Creating accounts to evade a previous ban.
• Any activity that threatens the security or integrity of the Service.

Upon termination, your right to use the Service ceases immediately. Any virtual currency, items, or other account data may be forfeited. We are not required to provide a refund for any purchases made prior to termination.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

10. Limitation of Liability

To the fullest extent permitted by law, Buildaverse LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

In no event shall our total liability to you for all claims arising from or related to the Service exceed the amount you have paid to Buildaverse in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty dollars ($50.00), whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Buildaverse LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
